1. Who we are
This website, ocianstore.com, is operated by DigitalScaler Sàrl, a company registered in Switzerland (Company ID / VAT no. CHE-417.800.689), Chemin de Maillefer 115, Lausanne, Vaud, 1018, Switzerland ("we", "us", "Ocianstore"). Ocianstore is a trading name of DigitalScaler Sàrl.
2. Scope
These Terms of Service apply to the use of ocianstore.com and to every order placed on it. By placing an order, you accept these terms. We currently sell and deliver to customers in the United States only.
3. Products
We take care to describe each product accurately: materials, sizes, colors and care instructions are listed on every product page. Colors may look slightly different depending on your screen. Product availability may change; an order is only accepted for items in stock.
4. Prices, taxes and payment
All prices are shown in U.S. dollars (USD). Any applicable sales tax is calculated and shown at checkout, together with the total amount, before you confirm your order. We accept Visa, Mastercard, Discover, Apple Pay, Google Pay, Shop Pay. Payments are processed securely by our e-commerce and payment providers; we never store your full card details.
If an item is shown at an incorrect price because of an error, we will contact you before dispatch: you may continue at the correct price or cancel the item for a full refund. Price changes never apply to orders already accepted.
5. Orders
Please provide accurate and complete information when you order. You receive a confirmation email after purchase. We may refuse or cancel an order when reasonably necessary, for example in case of suspected fraud, a payment issue, incorrect information, a pricing error or an item out of stock. If a paid order is cancelled, you receive a full refund.
6. Shipping and delivery
We deliver throughout the United States, including Alaska, Hawaii, U.S. territories and APO/FPO addresses. Standard shipping is free on all orders, with no minimum purchase. Orders are processed within 1 to 3 business days and then delivered in an estimated 6 to 9 business days. You receive a tracking number by email once your order ships; if you have not received it within 4 business days of placing your order, contact us at contact@ocianstore.com.
If we cannot ship your order within the stated time, we will tell you about the delay, give you a revised shipping date and offer you the option to cancel for a full refund; without a reply, we cancel the order and refund you in full. We ship with USPS, UPS, FedEx or our other delivery partners. If your parcel has not arrived within 15 business days of dispatch, contact us and we will investigate with the carrier; if it cannot be found within 30 business days of dispatch, you may choose a free replacement or a full refund. 7. Returns and refunds
You may return items within 30 days of delivery. Items must be unused, unwashed, in original packaging with all tags attached, with proof of purchase. Please email contact@ocianstore.com before sending anything back so we can send you return instructions; returns sent without authorization cannot be processed. Approved returns go to: Ocianstore Returns, 4600 20th Ave SW, Cedar Rapids, IA 52404, United States. Return shipping is paid by the customer, except for defective, damaged or incorrect items. There is no restocking fee. Approved refunds are issued within 10 business days after the return is received and approved to your original payment method. We do not offer direct exchanges. 8. Defective or incorrect items and warranties
If an item arrives defective, damaged or not as described, contact us within 48 hours of delivery, with a photo: we will send a replacement or issue a full refund at no cost to you. Except as stated in these terms and in our Return and Refund Policy, and to the extent permitted by law, products are supplied without any other express warranty. Nothing in these terms excludes implied warranties where that exclusion is not allowed by law. Some states do not allow such limitations, so they may not apply to you; you may also have other rights that vary from state to state.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, or for losses caused by events outside our reasonable control, and our total liability for an order is limited to the amount you paid for it. Some states do not allow these limitations, so they may not apply to you. Nothing in these terms limits rights that cannot be excluded under federal or state law.
10. Use of the website
You agree not to use this website for any unlawful or fraudulent purpose, to interfere with its operation or security, or to try to access our systems without authorization. The website may occasionally be unavailable for maintenance or technical reasons.
11. Intellectual property
The texts, logos, images and design of this website belong to DigitalScaler Sàrl or its licensors and may not be reused without our written permission, except where the law allows it.
12. Privacy
We handle your personal information as described in our Privacy Policy. We only share it with the service providers needed to process and deliver your order (payment, fulfillment and delivery partners).
13. Third-party services
Our website may use or link to third-party services that have their own terms and privacy policies. To the extent permitted by law, we are not responsible for services we do not control.
14. Governing law
These terms are governed by Swiss law, without prejudice to the mandatory consumer protection laws that apply to customers in the United States. Nothing in these terms limits your right to rely on applicable federal or state consumer protection laws.
15. Changes to these terms
We may update these terms from time to time. The latest version is always published on this page with its date. The terms that apply to your order are those in effect when you placed it.
